Bill to Close Rape Loophole up for Assembly Vote

SACRAMENTO -- A bill that would close a loophole for rape victims is on the Assembly floor for a vote.

Assembly Bill 65 would change an 1870's state law that says a man or a woman cannot be convicted of rape by impersonating a victim's significant other if the victim is not married.

That law was basis of a State Court Appeals ruling overturning the Santa Barbara County conviction of Julio Morales for impersonating the boyfriend of his victim. The bill was passed by the passed by the state Senate on Friday.
